Terms of Service

1. Acceptance of Terms

By accessing or using MakeImageTools ("makeimagetools.com", "the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. Your continued use of the Service following the posting of any changes to these terms constitutes acceptance of those changes.

2. Account Registration

To use certain features of the Service, you must create an account using a valid email address and password. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

You must be at least 18 years of age or the age of majority in your jurisdiction to create an account and use the Service.

3. Credits and Billing

The Service operates on a credit-based system. Each image processing operation consumes one credit. Your first image process is free (1 credit provided at no cost).

3.1 Subscription Plan

The monthly subscription plan costs $15/month and includes 15 credits. Subscription credits reset at the beginning of each billing cycle. Unused subscription credits do not roll over to the next billing period.

3.2 Credit Packs

You may purchase additional credit packs at $1 per credit. Purchased credits never expire and remain in your account until used, regardless of subscription status.

3.3 Payments

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees to your designated payment method.

3.4 Refunds

Credits that have already been used are non-refundable. Refund requests for unused credits or subscription cancellations will be reviewed on a case-by-case basis. You may cancel your subscription at any time, and you will retain access to your subscription credits for the remainder of your current billing period.

4. Acceptable Use

You agree not to use the Service to:

  • Upload, process, or distribute any content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
  • Upload content that infringes upon the intellectual property rights of any third party
  • Upload content that contains child sexual abuse material (CSAM) or exploits minors in any way
  • Use automated scripts, bots, or scrapers to access the Service without our prior written permission
  • Attempt to circumvent any rate limits, credit systems, or security measures
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service for any purpose that violates applicable local, state, national, or international law

We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including removing content and terminating accounts.

5. Intellectual Property

5.1 Your Content

You retain full ownership of all images you upload to and process through the Service. We do not claim any intellectual property rights over your uploaded or processed images. You are solely responsible for ensuring you have the necessary rights to any content you upload.

5.2 Our Service

The Service, including its design, features, code, and branding, is owned by MakeImageTools and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our express written consent.

6. Service Availability

We strive to maintain reliable access to the Service, but we do not guarantee 100% uptime or uninterrupted availability. The Service may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime in advance. We are not liable for any loss or damage resulting from Service interruptions or downtime.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAKEIMAGETOOLS AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe that you have violated these Terms of Service. Upon termination:

  • Your right to access and use the Service will immediately cease
  • Any unused subscription credits will be forfeited
  • We are not obligated to provide refunds for unused purchased credits if the termination is due to a violation of these terms

You may also delete your account at any time by contacting us. We may retain certain information as required by law or for legitimate business purposes.

9. Changes to Terms

We may update these Terms of Service from time to time. When we make changes, we will update the "Last updated" date at the top of this page. We encourage you to review these terms periodically. Your continued use of the Service after any changes constitutes your acceptance of the revised terms. If you do not agree with the updated terms, you should discontinue use of the Service.
